Jonathan Miller

Jonathan is the former Chief Prosecutor for the General Dental Council, where he led the investigation and prosecution of all Fitness-to-Practise cases going to hearing before a Practice Committee.

Jonathan has extensive experience of advising both individuals and statutory regulators. His extensive experience spans both defending and prosecuting in some of the most complex and high-profile cases.

Jonathan has represented clients in cases arising from serious allegations such as the Mid Staffordshire Trust scandal and the Operation Jasmine care home inquiry, demonstrating his adeptness in defending professionals under intense regulatory scrutiny. He has also been instructed by regulators to conduct investigations into clinical incompetence, financial impropriety, and fraud.

Notable Cases

SG – Successfully defended a senior healthcare professional in the Operation Jasmine inquiry, involving allegations of widespread abuse in care homes. SG was the only individual to remain on the register with a Caution Order.

RB – Represented a healthcare professional involved in the Mid Staffordshire Trust scandal. The case, which included allegations of neglect, resulted in the professional returning to practice, with all restrictions removed.

AW – Persuaded the regulator to issue a five-year caution following a consensual panel determination in a case involving the theft of medication from a hospital ward.

DG – Defended a senior professional accused of assaulting vulnerable patients in a secure mental health facility. After discrediting key witnesses, Jonathan successfully argued for a ‘no case to answer’ on each count, resulting in the professional being fully exonerated.

SV – Successfully defended a client against allegations of sexual assault, resulting in the complainant being discredited. The client was able to return to practice with a caution for unrelated clinical issues.

IO – Persuaded the regulator to offer no evidence in a case where the client’s fitness to practise was under question, securing a favourable outcome.

LH – Achieved a ‘no order’ ruling in an interim order hearing, allowing the client to continue practising without restriction.

Prosecutions for the Regulator

Akhtar v GDC – Successfully defended an appeal on behalf of the GDC regarding interim suspension and subsequent substantive suspension.

GDC v IH – Acted for the regulator in a complex case regarding an application for restoration to the register. The case involved several witnesses to character and uncovered further dishonesty by the applicant, leading to the restoration being refused.

Darfoor v GDC – Successfully defended an appeal to the High Court, resulting in costs being awarded against the appellant.

GDC v MS – Prosecuted a complex case involving clinical incompetence and financial impropriety, resulting in the professional being struck off.

GDC v GH – Acted for the regulator in a case involving financial impropriety related to NHS UDA costs, leading to the professional’s erasure from the register.

GDC v VA – Concluded a case by way of an agreed statement of facts, achieving a 12-month Suspension Order with significant savings.
